These Terms and Conditions govern the rental of equipment from AVI BROADCAST for live production, virtual setups, and other related services. By renting equipment from AVI BROADCAST, you agree to the terms outlined below.
1. Rental Equipment Offered
AVI BROADCAST offers a range of rental equipment including but not limited to:
- Cameras (e.g., broadcast-quality cameras, digital video cameras)
- Live Production Equipment (e.g., sound systems, lighting, audio mixers)
- Switchers (e.g., video switchers, audio switchers)
- Virtual Equipment (e.g., virtual production tools, software for live streaming, virtual sets)
The availability and specifications of rental equipment will be determined based on the event requirements.
2. Pricing and Payment Terms
- Pricing: Rental prices are determined on a per-event basis and may vary depending on the type of equipment, duration of the rental, and any specific event requirements. The final rental price will be discussed and agreed upon before confirmation of the rental agreement.
- Deposit: A deposit may be required to confirm the booking. The deposit amount will be specified at the time of the agreement and is refundable subject to the terms outlined below.
- Payment: Full payment for the rental equipment must be received prior to the event. Payment methods include bank transfer, UPI, or other agreed-upon methods.
3. Booking and Confirmation
- Reservation: To reserve rental equipment, a request form must be completed, specifying the types of equipment required, the rental period, and any additional services.
- Confirmation: Equipment reservations will be confirmed in writing upon receipt of the signed rental agreement and initial deposit (if applicable). A rental agreement outlining specific terms will be provided for each event.
4. Equipment Delivery and Setup
- Delivery and Pickup: AVI BROADCAST will deliver the rented equipment to the event venue based on the agreed-upon schedule. The client is responsible for ensuring that access to the venue is available for setup and return of equipment.
- Setup Assistance: AVI BROADCAST provides setup assistance based on the rental agreement. The cost for setup assistance (if applicable) will be outlined in the contract.
- Client Responsibility: The client is responsible for ensuring that the venue is suitable for the proper installation and use of the rented equipment.
5. Usage Guidelines and Maintenance
- Proper Use: The rented equipment must be used in accordance with standard industry practices. The client is responsible for training their staff in the proper operation of the equipment.
- Maintenance and Support: AVI BROADCAST will ensure that all equipment is in proper working order before delivery. Any equipment failure or malfunctions that occur during the event should be reported immediately. AVI BROADCAST will take reasonable steps to replace the equipment if necessary, but cannot be held responsible for any downtime or disruption to the event caused by equipment issues.
- Prohibited Usage: The client may not alter, modify, or attempt to repair the rented equipment. Any damage caused by misuse or unauthorized modifications will result in additional charges.
6. Damage, Loss, and Liability
- Equipment Condition: The client must inspect the equipment upon delivery and notify AVI BROADCAST of any defects or issues. Equipment is considered accepted upon delivery unless otherwise noted in writing.
- Damage or Loss: The client is liable for any damage or loss of rented equipment during the rental period. In the event of damage or loss, the client will be charged for the repair or replacement costs, as determined by AVI BROADCAST.
7. Cancellation Policy
- Cancellation by Client: If the client cancels the rental reservation, the deposit may be forfeited. If cancellation occurs within a certain period before the event (e.g., 7 days or less), a cancellation fee may apply based on the equipment reserved.
- Cancellation by AVI BROADCAST: In the event AVI BROADCAST is unable to provide the rental equipment due to circumstances beyond its control (e.g., equipment malfunction, unavailability), the client will be refunded any payments made.
8. Force Majeure
AVI BROADCAST will not be liable for any failure or delay in fulfilling the rental agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, technical malfunctions, or governmental actions.
9. Indemnity and Liability
The client agrees to indemnify and hold AVI BROADCAST harmless from any claims, damages, losses, or liabilities arising from the use of the rented equipment, including any injury, damage, or loss to property or persons during the event.
10. Governing Law and Dispute Resolution
These terms and conditions are governed by the laws of the jurisdiction in which the event takes place. Any disputes arising from the rental agreement will be resolved through mediation or arbitration, as determined by AVI BROADCAST.
11. Amendments to Terms and Conditions
AVI BROADCAST reserves the right to amend or update these rental terms and conditions at any time. Clients will be notified of any significant changes, and continued use of rental equipment after such changes constitutes acceptance of the updated terms.
